Shows that all legal systems of labour law, in a comparative perspective, assume that the employment relationship, as a social phenomenon, needs protective legislation, i.e. a legal apparatus for regulating individual rights and the duties of the parties. However, shows that while all legal systems know the category of the employment contract, it must be stressed that there are striking differences among legal orders as to how and how much the law should interfere with this social economic relationship.
