註釋It is the age-old story: developed and developing countries struggle for the control and protection of both resources and knowledge since time immemorial. Nowadays, these resources can be exported and patented elsewhere, regardless of where they originated or developed. At both sides of the strife, two treaties: TRIPs - embodying occidental values and approach -, and CBD - protector of developing countries' interests -. This essay will focus on finding a non-conflicting way these two treaties can be applied and proposing solutions as to safeguard the interests at play: the protection of native resources and knowledge, yet avoiding excessive regulations that may hinder innovation.
