註釋"This is an action in which the declaration states, that an agreement dated the 11th of January, 1819, was entered into, whereby it was agreed, that if the defendant purchased a ship called the Minerva, of which George Richardson was then the captain, that the plaintiff should give up the command of that ship to Captain John Mills ... and that if Capt. Mills should die, or give up the command of the Minerva, that the defendant would re-appoint the plaintiff to the command of that ship. It then states that Captain Mills died, but the defendant refused to comply with the said agreement, upon which issue is joined"--Page 6.
