註釋On 18 August 1992 the Attorney-General referred the Designs Act to the Commission for inquiry and report. The terms of reference required the Commission to have regard to the need: to ensure that industrial designs are adequately and appropriately protected; to modernise and simplify the Designs Act and remove difficulties that have arisen in its operation; and to ensure that persons whose rights under the Act have been infringed have access to a quick, cheap and effective remedy. This paper briefly outlines the current legislation protecting designs and raises issues that need to be examined before tentative proposals for reform can be formulated.
