In the advice, we have been requested to answer 11 questions covering whether there should be a new offence relating to workplace death; whether further legislative guidance should be given to courts when sentencing defendants who have committed offences against the occupational health and safety legislation; which courts should try occupational health and safety offences and which courts should hear appeals in occupational health and safety matters; and finally, whether the law relating to the liability of directors and managers in occupational health and safety matters should be strengthened." -- Introduction.
