Such a combination of instruments often leads to a loss of effect as well as to additional costs, due to insufficient coordination of the various regulations and unreasonable charges due to a cumulative interference with basic rights. Against this background, Sven Jesse examines the requirements of European and constitutional law in the face of the combined use of such instruments. As a reference he uses the energy efficiency law which is characterized by a wide range of instruments. The practical application of this combination of instruments as well as its history are presented according to subject areas, and the different combinations are assessed on the basis of the existing legal standards. German description: Zur Verfolgung eines bestimmten Regulierungsziels wird oft eine Vielzahl von Instrumenten nebeneinander eingesetzt. In einem solchen Instrumentenverbund drohen Wirkungseinbussen und Zusatzkosten durch eine unzureichende Abstimmung der unterschiedlichen Regelungen sowie unzumutbare Belastungen durch kumulativ wirkende Grundrechtseingriffe. Sven Jesse untersucht vor diesem Hintergrund die europa- und verfassungsrechtlichen Anforderungen an den kombinierten Instrumenteneinsatz. Als Referenzgebiet zieht er dabei das Energieeffizienzrecht heran, das durch ein breit gefachertes Instrumentarium gekennzeichnet ist. Die konkrete Ausgestaltung dieses Instrumentenverbundes sowie seine Entwicklung werden nach Gegenstandsbereichen dargestellt und die verschiedenen Kombinationen anhand der erarbeiteten rechtlichen Massstabe gewurdigt.
