Transforming Relationships Through Participatory Justice
註釋This report evaluates the extent to which participatory justice values & practical initiatives have taken root in the Canadian justice system. The first main section reviews the current experience of participatory justice with in-depth examinations of restorative justice in a criminal law context and consensus-based justice in a non-criminal context. Topics covered include the community justice movement, the policy framework, restorative & consensus-based justice processes, objectives & core values of these processes, and the common elements, critiques, & concerns of restorative & consensus-based justice. The second section addresses policy implications of participatory justice for existing dispute resolution processes in both criminal & non-criminal contexts. It discusses the significance in distinctions between conflict types & circumstances in considering the suitability of a relationship-focussed approach to conflict resolution; best practices in designing participatory justice practices; and balancing the role of government & community autonomy in developing & operating participatory justice programs. The final section makes recommendations regarding the development of fair participatory processes, the role of government, and strengthening a participatory culture.
