Teachers and school systems have been frequently held liable for the physical injuries to children in their care if their care fell short of an acceptable standard. But recently, cases have been brought before the courts of the United States of America where teachers and school systems were sued for negligent teaching. This thesis discusses educational negligence cases decided in the courts of the United States of America and explores their impact on Australian society. It is argued that the emerging American trends in the area of educational negligence may have an impact on Australian courts.
