註釋This chapter is a reflection on two papers by Francis Snyder that are book ends of his scholarship on soft law: his 1993 Modern Law Review article and his chapter in the Edward Elgar Research Handbook on Soft Law (2022). His 1993 article is famous for his definition of soft law so it is startling to read in the 2022 chapter his conclusion that the term 'soft law' should be jettisoned. How and why has he come to this particular conclusion? The key to understanding the 2022 chapter is the significance he gives to normative hybridity in providing the necessary governance tools for a sustainable future. This chapter will interrogate this idea of normative hybridity in the context of law, governance and regulation and our understanding of the relationship between them.
