Normatividade e economia em Portugal: a regulação da iniciativa privada antes do liberalismo (1603-1834 e antecedentes)
註釋This book examines the entire Portuguese normative universe up until the eve of the definitive establishment of the liberal legal order in 1834. Through this investigation, its aim is to determine the space that the ‘private sphere’ (comprising individuals, families, societies, and associations) had to lawfully carry out their actions or initiatives, particularly those of an economic nature involving the mobilization of assets and their conversion into capital. In this context, fiscal and administrative constraints are also considered, along with the conditions of access to justice and the informal procedures encouraged by formal rules. Focusing specifically on the period starting in 1603, with the last compilation of the Ordinances of the Kingdom, the study of the legal structure and its practical application in various sectors of activity is systematically related to its antecedents since the medieval period and in Roman law.
