This report analyzes the legality of Maher Arar's treatment under United States immigration law. The report begins with a summary of the relevant facts concerning Mr. Arar's detention in the U.S. in the fall of 2002 and his subsequent rendering to Syria, where he was allegedly tortured and detained for a year before finally being released without charges. The report then presents the following: definition of "rendition" and "extraordinary rendition"; overview of the United Nations Convention against Torture; summary of U.S. immigration provisions for removing someone from the U.S.; application of U.S. immigration law to the facts of Mr. Arar's case; recommendations intended to prevent another Arar- type situation from occurring.
