註釋English summary: The return of religion does also provide a challenge for constitutional law. It may well appear that the structures of the modern, liberal and constitutional state, comprising full religious and ideological freedom for its citizens on the one hand and religious and ideological neutrality of the state on the other, have been firmly established. However, the question arises as to whether religious elements are fundamentally embedded in this supposedly fully secularized political community or if they are otherwise present in a conceptual, institutional or functional sense. Clearly, the answer is no. The liberal, constitutional state can and must also manage the resurgence of religious life based on a secular approach. A separation of politics and religion is and remains the basis for freedom in the political community. German description: Die Ruckkehr der Religion stellt auch fur das Staats- und Verfassungsrecht eine Herausforderung dar. Zwar scheinen die Strukturen des modernen, freiheitlichen Verfassungsstaates mit umfassender Religions- und Weltanschauungsfreiheit der Burger einserseits, religios-weltanschaulicher Neutralitat des Staates andererseits fest gefugt. Doch erhebt sich die Frage, ob in das vermeintlich vollstandig sakularisierte politische Gemeinwesen sakrale Elemente konstitutiv eingelassen sind oder ihm sonst begrifflich, institutionell oder funktionell innewohnen. Die Frage ist im Ergebnis eindeutig zu verneinen. Der freiheitliche Verfassungsstaat kann und muss auch die Wiederkehr des Religiosen sakular verwalten. Die Trennung von Politik und Religion ist und bleibt die Basis der Freiheitlichkeit des politischen Gemeinwesens.
