William H. McCardle, newspaper editor of the Vicksburg Times, was charged with disturbing the peace and inciting rebellion during reconstruction in Mississippi; all considered military offenses. Lawyers for McCardle wanted the case heard before the Supreme Court. Prosecutors for the government argued that the military not the Supreme Court had jurisdiction over this matter. This was the first time in U.S. history where Congress removed the Court's jurisdiction to hear a case.
