Feasibility Analysis of Online Dispute Resolution in Developing Countries
註釋Is ODR suitable or convenient for developing countries? Would it be possible for ODR mechanisms to develop in regions without massive connectivity, such as Latin America? Would those mechanisms be useful in countries where access to the Internet is only reserved to a limited segment of the population? In this article, the authors argue that ODR is feasible for emerging economies like those in the Latin American region, even though access to the Internet has yet to become massive. In spite of certain areas of opportunity for improvement, the benefits are substantially more numerous than the difficulties involved in overcoming the challenges of ODR implementation in developing countries. After an overview of ODR, they focus on the strengths and then the challenges of ODR development in Latin America, before making some conclusive remarks on the feasibility of ODR in developing countries.
