Study on the Implementation of the Concessions Directive
註釋The Concessions Directive established a legal framework for the award of concession contracts in EU Member States and EEA countries, that was previously lacking. This study evaluates the functioning of the Directive, mapping the existing situation and providing an overview of how the Concessions Directive is currently applied and used. On the legal side, the study investigates the challenges with the definition of concessions in the countries' legal systems as well as the position of concessions under the Concessions Directive vis-à-vis other types of public-private partnership. In terms of scope of application, the study compares the pre- and post-Directive situations investigating whether there have been considerable changes in the use of concessions since the adoption of the Directive and whether the Directive contributed to the uptake of concession contracts in new areas that previously made recourse to other legal instruments. At the same time, data on the number of concessions awarded as well as their respective value are provided and evaluated. Case studies presenting specific examples of good and bad practices further illustrate the use of the Directive and provide possible lessons for contracting authorities.
