While the insanity defense has a long history in Canada, very little empirical attention has been paid to the practical aspects of its implementation. This report attempts to remedy some of that deficiency by outlining how the insanity defense is used in British Columbia. To fully describe the process by which the insanity defense is employed, the author reviewed Forensic Psychiatric Services referrals for 1989 and interviewed key personnel such as Crown and defense counsels, forensic psychiatrists, and forensic psychologists. Results presented and discussed include the frequency with which the insanity defense is raised, the type of behavior or evidence generally employed to raise the defense, the stage in judicial proceedings when the defense is raised, the duration of insanity assessments, the type and severity of crimes for which the defense is raised, and information about those remanded to the Forensic Psychiatric Institute for evaluation.
