註釋
Editors of casebooks in constitutional law have a job is more limited in opportunity than editors of casebooks in many other fields: controlling cases must be selected from the decisions of a single court, and the basic doctrine must be extracted from a single document. This casebook is divided into two parts. Part one deals with the allocation of governmental power, the scope of national legislative power, the scope of state power with respect to taxation and regulation, and the area of intergovernmental relationships. Part two, limitation of governmental power, constitutes only a little over fifty per cent of the content, devoted to the limitations on governmental power in the interest of individual liberty. The editors have achieved a good mixture of old and new cases. A chart in the appendix identifies the composition of the court at any specific date and is designed to help the student follow the relationship between changes in personnel and doctrine of the court. The editors have prepared a provocative, stimulating, and useful teaching tool for classroom use. It is a worthwhile addition to the available material and contains elements of uniqueness that entitle it to serious consideration by teachers of constitutional law.
