我國發展網路博弈電子商務之可行性研究

註釋觀諸我國近年來政府推行樂透彩, 運動彩券, 各大電視傳播媒體大量闡述賭博技術"212B38"賭博行為可謂隨處可見.而拜資訊科技發展所賜"212B38"網路穿越時空之限制"212B38"亦使得賭博行為於網際網路上迅速傳布.而網際網路之發展帶來龐大潛在的商機"212B38"若利用電子商務之形式"212B38"除了節省建造賭博場所之成本"212B38"得利用網際網路作為行銷之手段提供服務"212B38"更降低廣告宣傳之費用"212B38"並可減少人事成本之支出.本文研究之目的"212B38"乃為我國將來開放網路博弈之時"212B38"就賭博除罪化之議題, 管制及認證合法性等"212B38"為相關文獻整理與探討"212B38"並對開放網路博弈可能出現之問題"212B38"提出建議與解決方法.本論文之研究方法主要係從我國對於網路博弈處理之實務案例見解進行分析"212B38"以及我國對於賭博行為相關規範之管制探討"212B38"並輔以各國對於網路博弈相關政策之參考"212B38"作為我國對於網路博弈開放與否之良策.又我國是否開放"網路博弈""212B38"首先須從我國賭博罪是否除罪化進行解析其保護法益"212B38"及以刑法之手段處罰是否合理"212B38"以及其他除罪化理論之探討.而開放網路博弈並非一蹴可幾"212B38"必須要有全面之配套措施"212B38"作為開放背後之基礎.因此本文對於開放網路博弈產生之問題"212B38"提出幾個方向作為建言"212B38"如網路刑事管轄權, 網路服務提供者之責任, 管制等配套措施, 網路博弈課稅與否及未成人參與網路博弈等方面"212B38"以期此作為日後研究之基礎. In recent years the Taiwan Government and people for gambling is no longer a bad impression, for example, the implementation of our government lottery, sports lottery and other behavior, and the media in general set a large number of gambling technology, gambling can be said everywhere. Because the development of information technology benefits, not only across the Internet time and space constraints, but also makes gambling on the Internet and spread rapidly. In addition, the Internet has the maximum of greatest potential commercial possibilities, there are enormity advantages about using the e-commerce business model; first of all, saving the cost of the construction of a gambling establishment; secondly by using the Internet as a means of marketing services, can lower advertising expenses and thirdly is reduction of personnel costs of expenses. The purpose of this research is open for our future when the internet gambling, the question on the decriminalization of gambling, the legality of such control and certification, for the literature review and discussion, and open internet gambling problems that may occur to make suggestions and solutions. This research method mainly from Taiwan for the internet gambling processing analysis of practical cases of opinion and gambling in Taiwan for the control of the relevant norms, supported by national policies for the internet gambling reference, as a country for the network sound strategy game open or not. Also Taiwan is opening up internet gambling, in the first place whether it is from the decriminalization of Taiwan Gambling Protection Act for resolution of their interests and to a means of criminal punishment is reasonable and the other theory of decriminalization. The open internet gambling is not an overnight game and it must have a comprehensive package of measures as the basis for opening up the back. This article generated for open internet gambling problem, as the suggestions put forward in several directions, such as the internet criminal jurisdiction, the responsibility of Internet service providers, control measures such as internet gambling taxation and minors or juveniles participating in the internert gambling and so on to this as the basis for future research.
