註釋Please contact author, John Flood, for copy.This issue was specially published by the MLR in honour of Professor Simon Roberts in 2015.When it was published the paper was awarded the first Wedderburn Prize for the best article of the year by the MLR Editorial Committee in 1993.The paper was originally given at a Hart Legal Workshop on ADR organised by Simon Roberts who encouraged us to submit it to the MLR of which he was General Editor.The paper is an empirical study, based on interviews, of the ways in which lawyers and arbitrators handle construction disputes. This field is replete with disputes and has its own particular methods for resolving them. We examine their perceptions of how the dispute resolution process works, or doesn't. It remains one where lawyers and those who are not lawyers continuously contest the field.
