註釋This report includes, as appendices: (1) the final report from Sir Thomas Legg on the review of past payments to Members of Parliament of Additional Costs Allowance (the "second home allowance") and (2) the report from Sir Paul Kennedy on his decisions on appeals from MPs against Sir Thomas's rulings. Sir Thomas's report covers: the history and flaws of the ACA; his approach to the review; interpretation of the rules; application of the rules; individual conclusions and recommendations; the broad result; and an annex detailing the individual conclusions and recommendations for all MPs and former MPs. Over the five years reviewed some £55.5m was paid to MPs under the ACA. An additional £2.5m claimed by MPs was rejected by the Fees Office. Of that £55.5m about £11m (20 per cent) was initially called into question by the review. Of that £11m around £9.5m required validating by supporting evidence that should have been provided at the time. Only just under £1.5m was provisionally recommended for repayment and at this final stage this figure has reduced to just over £1.3m for repayment by 390 MPs. Sir Paul Kennedy's report details his decisions on appeals from 75 members. 44 applicants have been successful in whole or part and, as a result, there has been a reduction of some £180,000 in the amount recommended to be repaid. The Committee believes that the review process, though painful, has demonstrated the House's determination to deal with the problems over expenses and will contribute to restoring public confidence in Members of Parliament.
