摘要本文之主要目標在於研究"無線射頻辨識系統(RFID)"應用所衍生的法律關係及其間可能發生的法律問題"212B38"並參照歐盟和美國之案例及法案"212B38"進而對我國RFID應用之立法提出一些原則性的建議.首先"212B38"本研究從RFID的技術特性切入"212B38"探討其運作特性-"非接觸", "不易察覺"與"無所不在""212B38"功能特性-"個人識別", "定位"與"追蹤""212B38"及周邊效益-電子資訊傳遞, 蒐集, 處理與利用"212B38"所產生的法律問題.其次"212B38"藉著層別"國家對人民", "國家對企業"及"企業對消費者"的關係來剖析RFID實施者與使用者之間的法律關係.再者"212B38"從理論與實務的觀點來剖析其間各項權利的權衡"212B38"包括"隱私權", "資訊隱私權"與"消費者權益"及相對的"財產權", "營業自由"與"言論自由"等.最後"212B38"參照歐盟和美國之實際案例, 解決方案與相關立法"212B38"分析我國相關法律的適用及依據本文研究結論"212B38"針對RFID特性提出相關之修法建議. ABSTRACTThe goal of this research is the RFID legislation, since RFID is one of the most powerful technologies in 21th century that has the potential to allow governments or commercial entities to undermine individual control over private information. RFID readers and billions of RFID tags, which include wireless tracking devices, are predicted to make the technology poised to become ubiquitous. Nonetheless, in the absence of enforceable regulations, society risks being subjected to an unprecedented level of Orwellian surveillance. The steps of this research are, firstly, to disclose the legal issues deriving from the technical and operational features of RFID - being contactless, invisible and ubiquitous, its functional features - personal identification, positioning and surveillance and the side effects - persoal indetible information movement, collection, processing and use. Secondly, to reorganize and analyze the legal relation between Government, enterprises and consumers respectively, while appling the RFID technology. Third, to link and balance these legal relations to the human rights such as"right to privacy", "right to information provicy" and "consumers' rights", and in opposition the "free speech" and "right to property". And finally, to make proposals for RFID legislation and/or amendment in Taiwan, by referring to the cases and legislative solution in EU and USA.
