K.S.A. 39-1431, as amended by L. 2001, Ch. 154, section 4, does not mandate the reporting of domestic violence incidents unless the adult victim of the abuse is incapable of caring for himself or herself and is dependent upon others to provide those services that are necessary to maintain both physical and mental health. Moreover, K.S.A. 21-4213 which requires reporting certain wounds to law enforcement applies regardless of the circumstances under which the wounds were inflicted.
